The business relationship between TINT GmbH, Mainzer Landstraße 178-190, 60327 Frankfurt, and the customer is exclusively governed by the following General Terms and Conditions in the version valid at the time of order placement.

These General Terms and Conditions deem a consumer to be any natural person who completes a legal transaction for purposes that are for the most part not attributable to any professional activity of either a commercial or self-employed nature they engage in (as defined in § 13 BGB).
Neither the customer’s own terms and conditions nor any other terms and conditions that deviate from these General Terms and Conditions will be honored unless the vendor expressly consents to the validity thereof.
These terms and conditions govern your use of our website; by using our website, you accept these terms and conditions in full. (a) to the extent that the website and the information and services on the website are provided free-of-charge, we will not be liable for any loss or damage of any nature;
(b) we will not be liable for any consequential, indirect or special loss or damage;
(c) we will not be liable for any loss of profit, income, revenue, anticipated savings, contracts, business, goodwill, reputation, data, or information;
(d) we will not be liable for any loss or damage arising out of any event or events beyond our reasonable control;
(e) our maximum liability in relation to any event or series of related events will be limited to £1.00 GBP.
4. Price and payment
(a) Prices and any additional related charges (where applicable) are as published on our website for the relevant Goods and/or Services on the date of your order.
(b) Where Value Added Tax (VAT) is chargeable, this will be added and displayed separately at the checkout, and on the order summary and receipt at the current prevailing rate. This rate may vary from time to time.
(c) Payment for Goods and/or Services is accepted through major credit and/or debit cards excluding American Express, Diners, JCB and other corporate business cards. Your card will be charged directly after your order has been placed but the time taken to process the payment through your account will be dependant on your card supplier.
(d) TINT GmbH accepts no liability if a payment is refused or declined by the credit or debit card supplier for any reason.
(e) TINT GmbH accepts no liability for any loss or damage, arising directly or indirectly, as a result of a payment being refused or declined.
(f) You will be charged in the currency you have set up within your profile, currently available for USD.
(g) Confirmation of your payment will be displayed on screen once it has been authorized and accepted. You will also receive confirmation of the transaction to the email address you have provided.
(h) We reserve the right to refuse to process payments.
(i) We may at our sole discretion do such checks as we may deem fit before processing a credit or debit card payment from the user, for security reasons. As part of such checks, we may disclose personal data to third parties for the purpose of carrying out these security checks. In the event that we are not satisfied with the credibility of the User, we will have the right to reject the payment.
(j) We will not be liable for any damages resulting from our decision not to process a payment made through our Online Payments facility.
(k) We provide a free trial period for testing our service. The membership needs to be canceled actively in the free trial otherwise you will be charged automatically and the membership extended by one billing period.
(l) We do not provide refunds.
You hereby indemnify us and undertake to keep us indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute on the advice of our legal advisers) incurred or suffered by us arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.
6. Breaches of these terms and conditions
Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, we may take such action as we deem appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.
We may revise these terms and conditions from time-to-time. Revised terms and conditions will apply to the use of our website from the date of the publication of the revised terms and conditions on our website. Please check this page regularly to ensure you are familiar with the current version.
We may transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.

The legal domicile and place of fulfillment is the vendor’s headquarters insofar as the customer is a business person, a legal entity under public law or a special asset under public law.
The language of the contract is German.
